2024.11.13に欧州委員会のAI Officeがマルチステークホルダーアプローチの一環として、「AI法で定められたAIシステムの定義および禁止されたAI行為の適用に関する委員会ガイドライン (COMMISSION GUIDELINES ON THE APPLICATION OF THE DEFINITION OF AN AI SYSTEM AND THE PROHIBITED AI PRACTICES ESTABLISHED IN THE AI ACT)」に対するコメントを2024.12.11まで求めていたようですね...
それに対する欧州法研究所 (Euopean Law Institute; ELI) [wikipedia]が三要素アプローチという方法論をつかった提案をしているので、紹介です...
AI法の対象となるAIの定義についての話ですので、いろいろと参考になることがあるように思います...
法律をつくるとなると、立法課程、適用までの準備課程を含めて、議論が深まりますね...
欧州法研究所は、2011年にベルギー法に基づいて設立された会員制の非営利法人で、EU法的発展に焦点をあてた団体で、欧州議会、欧州連合司法裁判所 (CJEU)、国際連合国際商取引法委員会 (UNCITRAL)、国際私法統一研究所 (UNIDROIT)、欧州のいくつかの最高裁判所、法律事務所、学部、専門家協会 (欧州弁護士会・法曹協会協議会 (CCBE)、欧州連合公証人協議会 (CNUE)、欧州司法評議会ネットワーク (ENCJ)、欧州連合最高裁判所長官ネットワークなども会員に含まれているようですね。資金は、会員の会費の他、ウィーン大学、EUからの運営補助金等ですね...

| On 1 August 2024, the AI Act entered into force, marking a significant milestone in the EU's efforts to regulate artificial intelligence. This followed the establishment of the European AI Office in May 2024, which is tasked with ensuring the consistent application of the Act across Member States and providing guidance on its implementation. To prepare for the application of rules addressing high-risk AI systems and practices posing unacceptable risks, set to take effect on 2 February 2025, the European Commission launched targeted stakeholder consultation. These consultations aim to refine guidelines and support the development of codes of practice, paving the way for the Act's full implementation by 2026. In furtherance of the above, the Commission launched a Multi-Stakeholder Consultation for Commission Guidelines on the Application of the Definition of an AI System and the Prohibited AI Practices Established in the AI Act on 13 November 2024, to which the ELI contributed. | 2024年8月1日、AI法が施行され、EUの人工知能規制への取り組みにおける重要なマイルストーンとなった。これは、加盟国全体で同法の一貫した適用を確保し、その実施に関する指針を提供することを任務とする欧州AIオフィスの2024年5月の設立を受けてのことである。容認できないリスクをもたらす高リスクAIシステムおよび慣行に対処する規則の適用に備え、欧州委員会は対象を絞った利害関係者との協議を開始した。これらの協議は、ガイドラインを洗練させ、行動規範の策定を支援し、2026年までの同法の完全実施への道筋をつけることを目的としている。さらに、欧州委員会は、2024年11月13日に「AI法」で定められた「AIシステム」の定義および禁止されたAI行為の適用に関する欧州委員会ガイドラインの策定に向けた多者協議を開始し、ELIもこれに貢献した。 |
