経団連 英国国家サイバー諮問委員会 サイバー分野における官民連携に関する協力覚書の締結

こんにちは、丸山満彦です。

日本経団連と、英国国家サイバー諮問委員会 (National Cyber Advisory Board; NCAB) が国際的な官民連携を進めるために、覚書に締結したようですね。。。

英国は、金融庁のJapan Fintech Week 2024にも協力していますし、昨年から日本との関係強化に積極的のように見えますね。。。

さて、経団連の覚書の件ですが、こちらです。。。

同じ考え方の国同士なので、協力しましょうということですかね。。。

規制等の調和の話もありますね。。。

そういえば、昔、今のISMS制度を立ち上げた時のメンバーの1人なのですが、

当時の国の認定を廃止して民間に移そう、、、という流れの中で、経済産業省認定の安全対策事業者認定制度を廃止することが決まり、その受け皿を考えることになったのですが、その際に、私は当時の英国で始まったばかりの情報セキュリティマネジメントシステム認証（いわば、情報セキュリティ版ISOQ9001）を強くおして、いろいろな反対を押し切って、BS7799という英国標準をベースにした認証制度をつくったわけですが、結果的にBS7799は国際標準になり、当時は日本が一番認証取得が多い国になっていましたようね。。。

その時に、英国標準をそのまま使うのは日本としてはどうか？という話になり、ほぼ翻訳（一部日本風にアレンジして）、ISMSの規格としてつくったんですよね。。。懐かしい話ですね。。。

あっ、この覚書の日本側のSignerは遠藤さんですね。。。

Memorandum of Cooperation between the National Cyber Advisory Board of the United Kingdom and Keidanren on Public-Private Partnerships in Cyber	サイバー分野における官民連携に関するNCABと経団連の協力覚書
The National Cyber Advisory Board of the United Kingdom and Keidanren (Japan Business Federation) (hereinafter referred to individually as a "Participant" and collectively as the "Participants");	英国国家サイバー諮問委員会（NCAB：National Cyber Advisory Board）と経団連は、以下の内容について合意した。
Recognising the centrality of a "whole of system" approach and public-private partnership for an inclusive and engaged national and international dialogue on cyber;	サイバー分野に関する包括的かつ積極的に関与する、国内および国際的な対話のための官民連携の重要性を認識する。
Committing to a cyberspace that is free, fair, and secure, adheres with international law, maximises opportunities for economic growth and realises Society 5.0 for UN Sustainable Development Goals and Data Free Flow with Trust;	自由、公正かつ安全で、国際法を遵守し、経済成長の機会を最大化し、Society 5.0 for SDGsとDFFT（信頼性のある自由なデータ流通）を実現するサイバー空間にコミットする。
Seeking to ensure a Free and Open Indo-Pacific; build on the enhanced global strategic partnership between the UK and Japan as outlined in the Hiroshima Accord: an Enhanced Japan-UK Global Strategic Partnership; and deliver on the UK-Japan Cyber Partnership and the Memorandum of cooperation on people-to-people exchanges;	自由で開かれたインド太平洋（FOIP）を確保：「強化された日英のグローバルな戦略的パートナーシップに関する広島アコード」を基礎とし、日英サイバーパートナーシップおよび人的交流に関する協力覚書の実現を目指す。
Have reached the following recognition.
Paragraph 1	第1項
Purpose	目的
The purpose of this Memorandum of Cooperation (hereinafter referred to as the "MoC") is to deepen public-private partnerships in cyber between the UK and Japan.	この協力覚書（以下、MoC）の目的は、日英間のサイバー分野における官民連携を深化させることである。
Paragraph 2	第2項
Areas of cooperation	協力分野
1. Participants will cooperate in the following areas:	両者は以下の分野で協力する：
2. Building on the first "Japan-UK Cyber Partnership Mission" held in January 2024, convene regular engagements to deepen the Participants collaboration, share updates on national approaches and discuss current and emerging trends in cyberspace.	2024年1月に実施された第1回「日英サイバー協力ミッション」を踏まえ、両者の協力関係を深めつつ、各国の取組みに関する最新情報を共有し、サイバー空間における現状および新たな動向について議論するために、定期的に会合を開催する。
3. Develop and improve board of directors awareness on the need for cyber resilience, including supply chain protection.	サプライチェーン防護を含む、サイバーレジリエンスの必要性に関する経営層の認識を向上させる。
4. Identify solutions to the cyber skills shortage with a focus on professionalisation, best practice recruitment and targeted training support for entry level talent.	専門化、ベストプラクティスの採用、入門レベルに焦点を当てた人材育成等を通じて、サイバースキル不足に対する解決策を見出す。
5. Strengthen public-private collaboration on cyber resilience in context of future crises or conflicts.	将来の危機や紛争に備えたサイバーレジリエンスに関する官民連携を強化する。
6. Foster the growth of sustainable, innovative and internationally competitive cyber and information security sectors, harnessing quality products and services to meet the needs of government and the wider economy.	持続可能で革新的、かつ国際競争力のあるサイバーセキュリティ・情報セキュリティ分野の成長を促進し、質の高い製品とサービスを活用して政府ならびに広範な経済のニーズに応える。
7. Build a broader understanding of the threat posed by the irresponsible proliferation and use of advanced commercial cyber capabilities.	高度で営利的なサイバー能力が無責任に広がり使用されることによってもたらされる脅威について、より広範な理解を醸成する。
8. Discuss current and anticipated cyber regulation, balancing the need for safety and innovation. Where possible, assist in realising harmonisation of regulation and standards to generate cross-border value creation.	安全性とイノベーションのバランスを取りながら、現状や今後予想されるサイバー規制について議論する。国境を越えた価値を創造するための規制や標準・規格の調和の実現を支援する。
9. Where practicable, expand cooperation to include like-minded organisations with shared values.	価値観を共有する同志国・地域の機関を包含するための協力を拡充する。
Paragraph 3	第3項
Implementation and Governance	実行と統制
1. The Participants intend to implement the MoC through existing channels of engagement, bringing in relevant senior officials and experts as needed and where relevant.	1. 両者は、必要に応じて関係する高官や専門家を招き、本MoCを実施する。
2. The Participants will oversee the implementation of the MoC using relevant channels, including public and private engagements.	2. 両者は、官民の枠組みを利用して、本MoCの実施を監督する。
3. Any dispute arising out of the implementation of this MoC will be settled amicably through consultation between the Participants.	3. 本MoCに起因する紛争は、両者の協議を通じて友好的に解決する。
Paragraph 4	第4項
Commencement, Duration, Modification and Discontinuation	開始、期間、変更および中止
1. This MoC is not legally binding and does not give rise to any rights or obligations under domestic or international law, nor does it preclude any new areas of cooperation as identified by the Participants.	1. 本MoCは法的拘束力を持たず、国内法または国際法上の権利・義務を生じさせるものではない。また、両者が新たな協力分野を設定することを排除するものでもない。
2. This MoC will commence on the date of its signature by the Participants. Each Participant may discontinue this MoC by giving written notice to the other Participant of the intention to discontinue three (3) months in advance.	2. 本MoCは、両者が署名した日に効力が発生する。本MoCを破棄したい場合は、3か月前にその意向をもう一方に書面で通知することで破棄できる。
3. This MoC may be modified at any time in writing by mutual consent of the Participants. Such modification will commence on the date mutually determined by the Participants and form an integral part of this MoC.	3. 本MoCは、両者の合意により、いつでも書面により変更できる。かかる変更は、両者が決定した日に効力が発生する。
4. The discontinuation of this MoC will not affect the ongoing collaboration activities unless otherwise decided by the Participants.	4. 本MoCを破棄することは、両者が特段の決定をしない限り、継続中の協力活動に影響を与えない。
The foregoing represents the recognitions reached between the National Cyber Advisory Board of the United Kingdom and Keidanren (Japan Business Federation) on the matters referred to therein.	上記は、NCABと経団連の双方で言及した事項に関する合意を示すものである。
Signed in London, United Kingdom on 17 January 2024, in two originals in English, both copies having equal value.	本MoCは2024年1月17日に編纂され、英国ロンドンにて2本の正本に署名された。英文、和文ともに同じ価値を有する。
